{"id":3600,"date":"2024-08-05T21:39:06","date_gmt":"2024-08-05T19:39:06","guid":{"rendered":"https:\/\/focus-gruppe.de\/aktuelles\/building-services\/can-i-simply-give-notice-to-a-tenant\/"},"modified":"2024-09-30T13:18:33","modified_gmt":"2024-09-30T11:18:33","slug":"can-i-simply-give-notice-to-a-tenant","status":"publish","type":"post","link":"https:\/\/focus-gruppe.de\/en\/aktuelles\/guide\/can-i-simply-give-notice-to-a-tenant\/","title":{"rendered":"Can I simply give notice to a tenant?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\">As a landlord, you cannot simply terminate a tenant&#8217;s tenancy without further ado.\nGerman tenancy law protects tenants to a high degree and there are strict rules on when and how a landlord can terminate a tenancy.\nHere are the most important points:  <\/p>\n\n<h3 class=\"wp-block-heading\">1. <strong>reasons for termination<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Ordinary termination is only possible if there is a <strong>legally recognized reason for termination<\/strong>.\nThe most common reasons include <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Personal use:<\/strong> You or a close relative need the apartment yourself<strong>.<\/strong> <\/li>\n\n\n\n<li><strong>Breach of contractual obligations:<\/strong> For example, repeated <strong>delays in payment<\/strong> or <strong>disturbance of the peace of the house<\/strong>.<\/li>\n\n\n\n<li><strong>Termination for use:<\/strong> If you want to demolish or extensively convert the building and this is not compatible with the tenancy.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">2. <strong>notice periods<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Ordinary termination:<\/strong> The notice period depends on the duration of the tenancy and is at least <strong>3 months<\/strong>, but can increase to up to <strong>9 months<\/strong> for longer tenancies.<\/li>\n\n\n\n<li><strong>Extraordinary termination without notice:<\/strong> This is only possible in the event of serious breaches by the tenant, such as <strong>payment arrears<\/strong> of at least two months&#8217; rent or <strong>criminal acts<\/strong> against the landlord.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">3. <strong>formal requirements<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li>Notice of termination must be given <strong>in writing<\/strong> and clearly state the <strong>reason for termination<\/strong>.\nInformal or verbal termination is not legally valid. <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">4. <strong>blocking period for termination for personal use<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">If you have recently bought the apartment, there may be a lock-up period (up to <strong>3 years<\/strong> or longer, depending on the region) before you are allowed to give notice due to personal use.<\/p>\n\n<h3 class=\"wp-block-heading\">5. <strong>hardship regulation<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Tenants can object to the termination if there is a so-called <strong>case of hardship<\/strong>.\nThis may be the case, for example, if the tenant is seriously ill or cannot find suitable alternative accommodation. <\/p>\n\n<p class=\"wp-block-paragraph\">Before you give notice, you should definitely check the legal framework or consult a tenancy lawyer to ensure that your notice is effective.<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>As a landlord, you cannot simply terminate a tenant&#8217;s tenancy without further ado.
